Advance parole (Form I-131) processing time: how to check your case, expedite urgent travel and avoid abandoning your green card

You generally must apply for and receive your approved Form I-131 travel document before you leave the United States, or USCIS will consider your pending Form I-485 green card application or Form I-589 asylum application abandoned. Because wait times vary by category and USCIS office, check your current estimate on the USCIS Processing Time Information page.

If you have a pressing or critical need to travel, USCIS asks you to submit an expedite request on a pending application at least 45 days before departure, or request an emergency local field office appointment if you must leave in less than 15 days.

How to check your Form I-131 processing time and case status

Form I-131 (Application for Travel Documents, Parole Documents, and Arrival/Departure Records) covers several different travel documents, and USCIS tracks their timelines by category and the office handling your file. On the USCIS Fee Schedule and processing tools, USCIS separates Form I-131 into Reentry Permits (Part 1, Box 1), Refugee Travel Documents (Part 1, Box 2 or 3), TPS Travel Authorization Documents (Part 1, Box 4), Advance Parole Documents (Part 1, Box 5), Advance Permission to Travel for CNMI Long-Term Residents, Initial Parole Documents from outside the US, Initial Parole in Place, and Arrival/Departure Records for Re-parole.

Before you make any travel plans, check your pending Form I-131 and its related green card application in three ways:

  • Check average wait times by category and office: go to the USCIS Check Case Processing Times page and select Form I-131, your specific travel document category, and the service center or field office listed on your receipt notice.
  • Look up your individual receipt number: use the USCIS Case Status Online tool with your Form I-131 or Form I-485 receipt number to see the latest action on your file.
  • Call if your case is taking longer than expected: contact the USCIS Contact Center at 800-375-5283 (TTY 800-767-1833) to ask about an application that has passed normal processing times.

Which Form I-131 travel document do you need, and can you file online?

Only certain Form I-131 categories are eligible for online filing through a myUSCIS account. USCIS warns that if you file online under the wrong category just to use the online system, it may deny your Form I-131 without refunding your fee.

If you are filing Form I-485 online using PDF upload, you can file Form I-131 concurrently with your Form I-485 package, or file Form I-131 online later if your pending Form I-485 receipt number begins with IOE. While adjustment of status applicants often apply for Form I-765 (Application for Employment Authorization) and Form I-131 while Form I-485 is pending, USCIS issues an approved Advance Parole Document as a standalone Form I-512L travel document (and for certain re-parole requests under Part 1, category 10.G, allows selecting an EAD checkbox in Part 9).

If you are transitioning from a fiancé(e) or spousal visa to permanent residence, see our guides on K-1 visa processing time and CR-1 visa processing time to compare how adjustment of status fits into your timeline.

What happens if you travel while Form I-485 is pending (and the August 2026 unlawful presence rule)

Travel outside the United States while an application is pending carries strict legal rules. USCIS emphasizes three points before and after Form I-131 approval:

Leaving before approval abandons your case. If you depart while Form I-485 is pending without first obtaining advance parole, USCIS will deny your case unless you fit into a narrow exception for people with certain nonimmigrant statuses. If you filed Form I-539 to change nonimmigrant status, leaving the US before a decision generally abandons Form I-539, even if you hold an advance parole document.

August 13, 2026 rule on unlawful presence bars (Matter of Delcarmen-Lara). On August 13, 2026, the Board of Immigration Appeals issued Matter of Delcarmen-Lara, 29 I&N Dec. 830 (BIA 2026), overruling the 2012 Matter of Arrabally and Yerrabelly decision. As of August 13, 2026, departing the United States with a valid Advance Parole Document (Form I-512L) counts as a departure for inadmissibility under INA section 212(a)(9)(B)(i). If you accrued more than 180 days of unlawful presence in the United States, depart, and seek admission again within the 3-year or 10-year statutory period, you may be found inadmissible upon your return, even with an Advance Parole Document.

Advance parole does not guarantee reentry. Airlines can accept an advance parole document or TPS travel authorization document instead of a visa to let you board a flight to the United States, though it does not replace your passport. At the airport or border, a U.S. Customs and Border Protection (CBP) officer will inspect you and make the final decision on whether to allow you to reenter.

How to expedite Form I-131 vs. get an emergency advance parole appointment

If standard USCIS processing times will not finish before you have to leave, USCIS provides two separate tracks for applicants inside the United States depending on how many days remain before departure. For Humanitarian Parole requests for individuals outside the United States, you do not need to call the Contact Center. Include information supporting the need for expedited processing directly with your Form I-131 filing.

Here is how the two urgent travel paths compare side by side.

USCIS expedite criteria and required evidence for urgent travel (45+ days out)

USCIS reviews every expedite request on a case-by-case basis under its Policy Manual (Volume 1, Part A, Chapter 5, current as of October 27, 2026) and generally requires supporting documentation. Wanting to travel solely for a vacation does not qualify as a pressing or critical need.

Across USCIS benefits, officers weigh five general expedite criteria:

  • Severe financial loss to a company or person, such as an inability to travel for work that would result in job loss, provided the urgency is not from failing to timely file or timely respond to a request for evidence.
  • Emergencies or urgent humanitarian situations related to human welfare.
  • An IRS-designated nonprofit organization whose request furthers US cultural or social interests based on the beneficiary's specific role.
  • US government interests, including cases identified as urgent by a federal, state, tribal, territorial, or local government because they involve public interest, public safety, national interest, or national security.
  • Clear USCIS error when there is an urgent need to correct the mistake.

For Form I-131 travel requests specifically, USCIS recognizes two situations: unexpected events (such as obtaining medical treatment in a limited amount of time, or the death or grave illness of a family member or close friend) and planned events delayed by processing times.

Worked example from the USCIS Policy Manual: Suppose you learn of a pressing work conference, academic study abroad program, or family wedding and file Form I-131 as soon as practicable. Five months later, your Form I-131 is still pending and your departure date is now 45 days away. Because you filed timely when you learned of the commitment and responded timely to any request for evidence, USCIS lists this exact scenario as an example that may warrant expedited processing.

Before you submit an expedite request, finish any pending action on your side. Uncompleted biometrics appointments, pending interviews, required medical examinations, or pending third-party background checks will prolong or prevent USCIS from expediting your file. Submit only one expedite request, because multiple requests can delay processing.

Reason for urgent travelExamples of supporting evidence to upload or submit
Death of a family member or close friendLetter from the funeral parlor or hospital, death certificate, or obituary, plus proof of your relationship to the deceased (birth certificate, marriage certificate, or affidavit).
Illness of a family member or close friendLetter from a doctor, hospital, or clinic stating the pressing or critical nature of the health issue, plus documentation of your connection to the ill person.
Pressing or critical medical treatment for yourselfLetter from a doctor, hospital, or clinic documenting the pressing or critical nature of the medical treatment.
Professional commitment (meeting, conference, forum, seminar, or training)Letter from your employer on company letterhead, meeting agenda, or invitation documenting the pressing or critical nature of the commitment.
Academic commitment (study abroad, research trip, forum, seminar, conference, or practicum)Letter from the academic institution, curriculum, or agenda, plus documentation of the pressing or critical nature of the commitment.
Wedding or personal commitment (such as a graduation)Invitation or reservations. If the event is not yours, include proof of your relationship to the individual and why your attendance is pressing or critical.

Checklist: what to bring to an emergency advance parole appointment (travel in under 15 days)

If you must leave the United States in less than 15 days for a medical emergency, a grave illness or death of a family member or close friend, or a planned commitment where you already timely applied and requested an expedite that is still pending, you can ask for an emergency appointment at a local USCIS field office via 800-375-5283 or My Appointment.

Use this checklist from the USCIS Emergency Travel and Form G-1055 Fee Schedule rules:

  • A new, completed, and signed Form I-131 (edition date 01/20/25): required even if you already have a Form I-131 pending with USCIS.
  • A new filing fee and valid payment method (no cash): even if you already paid for a pending Form I-131, you must pay any applicable filing fee again at the field office. Under Form G-1055 rules for filing at a USCIS office, pay through Pay.gov using a credit or debit card, or by electronic funds transfer (EFT) from a US bank account using Form G-1650 (Authorization for ACH Transactions). Cash is never accepted.
  • Evidence of your eligibility for the travel document: such as your Form I-485 receipt notice or TPS approval.
  • Evidence of your pressing or critical need to travel: medical letters, death certificate, employer letter, or proof of your prior timely filing and expedite request.
  • Two passport-style photos: meeting Department of State photo specifications.
  • Certified English translations: required for any document in a language other than English.

What the officer may ask at an emergency field office appointment or when you return through CBP

While most standard Form I-131 applications are decided on paper before your marriage green card interview, you will speak directly with an officer if you attend an in-person field office appointment for an emergency travel document, and when a CBP officer inspects you at the port of entry upon your return.

Based on the USCIS Travel Documents and Emergency Travel rules, prepare for these questions and have the matching documents ready:

"Why do you need to leave the United States within the next 15 days, and why couldn't this wait for standard processing?"

  • What it checks: whether your trip meets the pressing or critical human welfare, medical, or time-sensitive commitment threshold rather than an ordinary vacation.
  • How to prepare: have your dated hospital letter, funeral documentation, or employer/academic letter ready, along with translated birth or marriage certificates showing your relationship.

"Did you already file Form I-131, and when did you learn about this event?"

  • What it checks: for planned events, USCIS policy checks whether you filed Form I-131 as soon as practicable after learning of the event and already requested an expedite.
  • How to prepare: bring your Form I-797C receipt notice, the date you learned of the event, and your prior expedite confirmation number.

"What is your pending application or current immigration status in the United States?"

  • What it checks: at the port of entry, the CBP officer verifies that your advance parole (Form I-512L) or TPS travel authorization (Form I-512T) matches an active underlying benefit.
  • How to prepare: carry your unexpired passport, your original Form I-512L or I-512T, and a copy of your Form I-485 receipt notice or TPS approval notice.

"How long were you outside the United States, and have you ever accrued more than 180 days of unlawful presence in the US?"

  • What it checks: whether your trip was temporary and whether your departure triggered the 3-year or 10-year unlawful presence bar under INA section 212(a)(9)(B)(i) following the August 13, 2026 Matter of Delcarmen-Lara decision.
  • How to prepare: know your exact travel dates, carry your prior I-94 records and approval notices showing your lawful status history, and speak with an immigration attorney before departing if you have any unlawful presence or a removal order.

2026 Form I-131 filing rules, edition date, address changes and lost documents

Check these USCIS filing rules before you submit so a rejected form or wrong address does not delay your application:

Use the 01/20/25 form edition. Make sure the 01/20/25 edition date and page numbers are visible at the bottom of every printed page and that all pages match the same edition, or USCIS may reject your form.

Check the October 7, 2026 mail filing location change. On October 7, 2026, USCIS changed the direct mail filing locations for Form I-131, with a 30-day grace period accepting forms sent to prior locations if postmarked on or before November 9, 2026. Sending a mailed Form I-131 to the wrong address can delay processing.

Check the 10/26/26 Fee Schedule (Form G-1055) and payment rules. USCIS published a new edition of Form G-1055 (10/26/26) on October 28, 2026. Include the exact fee unless you qualify for a fee exemption ($0 filing fee) or submit a paper Form I-912 (Request for Fee Waiver). When filing by mail at a USCIS lockbox, pay by credit, debit, or prepaid card using Form G-1450, or by US bank account ACH transfer using Form G-1650 (unless you file Form G-1651 for a paper fee payment exemption). Clip Form G-1145 to the first page for an email or text when the lockbox accepts your form.

File Ukrainian re-parole within the 180-day window. Eligible Ukrainian citizens and immediate family members applying for re-parole on Form I-131 should file no earlier than 180 days (6 months) before their current Form I-94 parole period expires, or USCIS may reject or deny the application without refunding the fee.

Update your address within 10 days and use Form I-131A if a document is lost abroad. If you move while your Form I-485 is pending, update your address with USCIS within 10 days, as changing your address with the U.S. Postal Service does not update USCIS. If you are already outside the United States and your Green Card, reentry permit, advance parole document, or TPS travel document is lost, stolen, or destroyed, file Form I-131A (Application for Carrier Documentation).

Frequently asked questions

Can I leave the United States while my Form I-131 advance parole application is pending?

No. USCIS states that you generally must apply for and obtain your travel document before you leave the United States. If you depart while Form I-485 is pending without first obtaining advance parole, USCIS will deny your green card application (unless you fit a narrow nonimmigrant exception), and leaving without advance parole while Form I-589 is pending causes USCIS to assume you abandoned your asylum application.

When should I request an I-131 expedite versus an emergency advance parole appointment?

If you have a pressing or critical need to travel and already have a receipt notice for a pending Form I-131, USCIS encourages you to submit an expedite request at least 45 days before your intended departure date. If you must travel outside the United States in less than 15 days for an emergency, call the USCIS Contact Center at 800-375-5283 or use My Appointment to request an in-person emergency appointment at a local USCIS field office.

Do I have to file a new Form I-131 and pay another fee for an emergency field office appointment?

Yes. USCIS states that even if you already have a Form I-131 pending, you must bring a newly completed and signed Form I-131 along with any applicable filing fee to your local field office appointment. At a USCIS field office, you must pay through Pay.gov using a credit or debit card or via ACH bank transfer using Form G-1650, as cash is never accepted.

Can I file Form I-131 online for advance parole or a reentry permit?

Reentry permits (Part 1, Box 1) and refugee travel documents (Part 1, Box 2 or 3) cannot be filed online and must be mailed on paper. You can file Form I-131 online for TPS travel authorization (Box 4), DACA advance parole (Box 5.E), or advance parole based on a pending Form I-485 (Box 5.A) only if your Form I-485 receipt number begins with IOE (or concurrently if filing Form I-485 online via PDF upload).

Does traveling on an approved Advance Parole Document trigger unlawful presence bars in 2026?

Yes, if you accrued more than 180 days of unlawful presence before leaving. Under the August 13, 2026 Board of Immigration Appeals decision in Matter of Delcarmen-Lara (which overruled Matter of Arrabally and Yerrabelly), departing the United States with an Advance Parole Document counts as a departure under INA section 212(a)(9)(B)(i) and can trigger the 3-year or 10-year inadmissibility bar upon your return.

Does an approved advance parole document guarantee that I can reenter the United States?

No. An advance parole document allows an airline to let you board a flight to the United States without a visa, but a U.S. Customs and Border Protection (CBP) officer at the airport or border will inspect you and make the final decision on whether to allow you to reenter.
