H-4 EAD automatic extension: what changed, and what it means for your renewal
The up-to-540-day automatic extension for H-4 EAD renewals ended for applications filed on or after October 30, 2025. Under the DHS final rule effective October 14, 2026 (91 FR 65306), H-4 spouses in category (c)(26) who file on or after that date must wait for USCIS to approve the renewal before working past their current card's expiration date. Renewals filed before October 30, 2025 keep the old extension.
Every rule below comes from the Federal Register, 8 CFR 274a.13 and USCIS's own pages, checked on November 3, 2026.
What changed, and when?
On October 30, 2025, DHS published an interim final rule (90 FR 48799) ending automatic EAD extensions for certain renewal applicants. On October 14, 2026, DHS published a final rule (91 FR 65306), effective the same day, that finalized the 2025 rule without changes.
| Date or number | What it means |
|---|---|
| October 30, 2025 | The cutoff set by the interim final rule. Renewals filed on or after this date get no automatic extension. |
| October 14, 2026 | The final rule (91 FR 65306) takes effect and keeps the 2025 rule without changes |
| Up to 540 days | The old maximum automatic extension, which now applies only to qualifying renewals filed before October 30, 2025 |
Under 8 CFR 274a.13(e), a Form I-765 renewal filed on or after October 30, 2025 gets no automatic extension of work authorization or EAD validity, unless the law or a Federal Register notice for Temporary Protected Status (TPS) says otherwise. DHS said in the final rule that ending automatic extensions puts national security, public safety and benefit integrity first, so USCIS finishes background vetting, screening and eligibility checks before granting a new period of work authorization.
How does the rule affect H-4 spouses in category (c)(26)?
The final rule doesn't change who can apply. H-4 spouses can still file Form I-765 if the H-1B spouse is the beneficiary of an approved Form I-140, or has H-1B status under sections 106(a) and (b) of the American Competitiveness in the Twenty-first Century Act of 2000 (AC21).
What changes is the gap. H-4 spouses under 8 CFR 274a.12(c)(26) aren't authorized to work incident to their status, so they need a valid EAD to work. Under 8 CFR 274a.13(e)(2), if you file a renewal on or after October 30, 2025, your EAD and work authorization end the day after the end date printed on the card. If USCIS hasn't approved the renewal by then, you must stop working and can start again only once USCIS approves it and issues a new EAD.
Other categories lost the automatic extension for filings on or after October 30, 2025 too, including adjustment of status applicants under (c)(9) and pending asylum applicants under (c)(8). Nonimmigrants authorized to work incident to status under 8 CFR 274a.12(a), such as L-2 spouses with the right Form I-94 notation, keep work authorization while their status is valid. F-1 students applying for a STEM OPT extension have a separate 180-day automatic extension rule.

What happens to pending H-4 EAD renewals?
Whether you can keep working while your renewal is pending depends on the Received Date on your Form I-797C receipt notice and the expiration date on your Form I-94.
| Form I-765 received | Automatic extension | When work authorization ends | What to show for Form I-9 |
|---|---|---|---|
| Before October 30, 2025 (and before the EAD expired) | Up to 540 days or until the Form I-94 expires, whichever is sooner (8 CFR 274a.13(d)) | The earliest of the I-94 expiration date, 540 days after the EAD expired, or the date USCIS denies the renewal | The expired EAD (category C26), the Form I-797C receipt notice with a Received Date before October 30, 2025, and an unexpired Form I-94 showing H-4 status |
| On or after October 30, 2025 | None (8 CFR 274a.13(e)) | The day after the Card Expires date on the current EAD, unless the renewal is approved first | The new unexpired EAD (Form I-766) issued after USCIS approves the renewal |
How do the dates work out? Two worked examples
These examples were worked out by our team from 8 CFR 274a.13(d) and (e) and USCIS's Handbook for Employers (M-274). The people and dates are invented.
Maya filed before the cutoff. Her H-4 EAD (C26) expires December 1, 2025, and her H-4 Form I-94 is valid until August 15, 2026. Her receipt notice shows a Received Date of October 15, 2025, so 8 CFR 274a.13(d) applies. 540 days from December 1, 2025 would reach May 25, 2027, but the extension lasts up to 540 days or until the I-94 expires, whichever is sooner. So her extension ends August 15, 2026 (257 days after her card expires), unless USCIS decides her I-765 earlier.
Priya filed after the cutoff. Her H-4 EAD (C26) expires August 10, 2026, and her I-94 runs to August 10, 2028. She files her renewal on February 11, 2026, 180 days before her EAD expires. Because that's on or after October 30, 2025, 8 CFR 274a.13(e)(2) applies and she gets no extension days. If USCIS approves her I-765 on September 1, 2026, her work authorization ends August 11, 2026, and she can't work for 21 days, from August 11 through August 31, 2026.
When and how should you file the renewal?
With no automatic extension for new filings, filing early with a complete package is the main way to lower the risk of a gap.
- The 180-day window. USCIS's Form I-765 page recommends filing a renewal up to 180 days before your EAD expires, and at least 90 days before. Two government sources differ on filing earlier. USCIS's H-4 spouses page (last updated August 2, 2024) says you can't file more than 180 days before your EAD expires. But in the final rule's preamble (91 FR 65306, at 65324 and 65325), DHS says there's no rule against filing earlier, and USCIS won't reject or deny an otherwise eligible renewal just because it was filed more than 180 days ahead.
- Filing with Form I-539 and Form I-129. Under (c)(26), you can file Form I-765 together with your Form I-539 and your H-1B spouse's Form I-129. USCIS won't decide your I-765 until it has decided the I-539, the I-129, or both.
- Filing with Form I-485. If you file Form I-765 with Form I-485, USCIS's instructions say to use category (c)(9), not (c)(26), and to file at the Form I-485 address. A Form I-485 package sent to the (c)(26) address will be rejected.
- Expedite requests. The final rule notes you can ask USCIS to expedite a case. USCIS weighs each request case by case, at its sole discretion, and generally wants supporting documents.
| What you're filing | Where it goes |
|---|---|
| Form I-765 alone (already in H-4 status, no extension needed) | The USCIS lockbox on the Direct Filing Addresses for Form I-765 page |
| Form I-765 with Form I-539 (extending H-4 status) | The USCIS lockbox on the Direct Filing Addresses for Form I-765 page |
| Form I-765 with both Form I-129 (H-1B) and Form I-539 (H-4) | The USCIS service center with jurisdiction over the Form I-129 |

What goes in the H-4 EAD renewal package?
Our team put this checklist together from USCIS's Form I-765 page and its H-4 spouses page. Sending all the initial evidence helps avoid a Request for Evidence, which DHS notes can delay a decision.
- Evidence of H-4 status: your current Form I-797 approval notice for Form I-539, or your Form I-94 showing H-4 admission or your latest approved extension of stay.
- Government-issued photo ID: your last EAD, passport biometric page, birth certificate with photo ID, foreign consulate visa, or national ID with photo.
- Proof of relationship: your marriage certificate to the H-1B spouse.
- Eligibility through the I-140: the Form I-797 approval notice for the H-1B spouse's Form I-140.
- Eligibility through AC21 106(a) and (b): the H-1B spouse's passports, prior Forms I-94, and current and prior Forms I-797 for Form I-129, plus evidence that a labor certification application or Form I-140 was filed at least 365 days before the AC21 admission period begins. If DOL certified the labor certification more than 180 days ago, include the I-140 receipt notice showing it was filed within 180 days of certification.
- Photos: two identical 2 by 2 inch passport-style color photos, unmounted and unretouched.
Before mailing, check three October 2026 alerts on USCIS's Form I-765 page:
- Form edition. Under a September 14, 2026 court order in Presidents' Alliance on Higher Education and Immigration v. DHS, USCIS still accepts the 08/21/25 edition of Form I-765 (and the 08/28/24 edition of Form I-539) and isn't accepting the 09/15/26 editions.
- Filing locations. USCIS changed the I-765 mailing addresses on October 7, 2026. It accepts forms postmarked on or before November 9, 2026 at any prior address. Check the Direct Filing Addresses page before mailing.
- Fees. Certain H.R. 1 immigration fees rose for inflation on October 16, 2026. Check USCIS's Fee Schedule page for your category.
After approval, the EAD should be produced within 2 weeks and sent by USPS Priority Mail. USCIS asks you to allow 30 days from approval before asking about it. For a consular trip, our documents required for a US visa interview list and US visa interview tips help you prepare.
What does this mean for employers?
Under section 274A of the Immigration and Nationality Act and 8 CFR part 274a, employers must reverify work authorization on Form I-9 when an employee's documents expire. For H-4 EAD renewals filed on or after October 30, 2025, a Form I-797C receipt notice can't extend work authorization past the card's expiration date.
In the final rule's economic analysis (91 FR 65306, at 65308), DHS estimates that across all affected EAD categories, 20,000 to 33,000 EADs may lapse in a single 18-month window starting in May 2027, affecting about 1,700 to 2,800 employers.
A question to practice
"Do you plan to work in the United States while on an H-4 visa?"
A strong answer covers: that you can't work on H-4 alone, that work needs an approved EAD from USCIS, and the real basis for your eligibility, such as your spouse's approved Form I-140.

Frequently asked questions
Did DHS end the H-4 EAD automatic extension?
Yes. DHS published an interim final rule on October 30, 2025 and finalized it without changes in a final rule effective October 14, 2026 (91 FR 65306). Renewals filed on or after October 30, 2025 no longer get the up-to-540-day automatic extension.
What if my H-4 EAD renewal was filed before October 30, 2025?
The rule doesn't reach back. H-4 spouses in category (c)(26) who properly filed before October 30, 2025 still get an automatic extension of up to 540 days past the card's expiration, or until their unexpired Form I-94 expires, whichever is sooner.
Can I keep working if my H-4 EAD expires while a renewal filed on or after October 30, 2025 is pending?
No. Under 8 CFR 274a.13(e)(2), your EAD and work authorization end the day after the end date on the card. You can work again once USCIS approves the renewal.
How early can I file my H-4 EAD renewal?
USCIS recommends filing up to 180 days before your EAD expires, and at least 90 days before. USCIS's H-4 page says you can't file more than 180 days ahead, but the October 14, 2026 final rule says USCIS won't reject or deny an otherwise eligible renewal just because it was filed earlier.
Can I file my H-4 EAD renewal with Form I-539 and my spouse's Form I-129?
Yes, under category (c)(26) you can file all three together. USCIS won't decide your Form I-765 until it has decided the Form I-539, the Form I-129, or both.
What do I show my employer if I qualify for the pre-October 30, 2025 extension?
USCIS's Handbook for Employers (M-274) lists your expired EAD showing category C26, your Form I-797C receipt notice with a Received Date before October 30, 2025 (and on or before the EAD expiration date), and an unexpired Form I-94 showing H-4 status.
