H-4 EAD: Who Qualifies, Processing Time and the 2026 Rules

Certain H-4 dependent spouses of H-1B workers can apply for an Employment Authorization Document (EAD, Form I-766) by filing Form I-765 under eligibility category (c)(26) if the H-1B spouse has an approved Form I-140 or has been granted H-1B status beyond the 6-year limit under AC21 sections 106(a) and (b), according to U.S. Citizenship and Immigration Services (USCIS).

You cannot begin working until USCIS approves your Form I-765 and you receive your physical EAD card, which USCIS generally grants to match your Form I-94 expiration date for up to 3 years. Under a Department of Homeland Security (DHS) interim final rule effective October 30, 2025, applicants who file to renew an EAD on or after that date no longer receive an automatic extension while the renewal is pending.

Who qualifies for an H-4 EAD

To apply for an H-4 EAD, you must hold valid H-4 dependent spouse status in the United States, or be filing to extend or change to H-4 status at the same time. Only H-4 dependent spouses qualify under category (c)(26). Unmarried H-4 children do not qualify for employment authorization under this category.

Your eligibility depends on your spouse's H-1B visa and employment-based permanent residence progress. According to USCIS guidance on employment authorization for certain H-4 dependent spouses, you qualify if your H-1B principal spouse meets one of the conditions in the table below.

What changed in 2025 and 2026 for H-4 EAD applicants

Between October 2025 and October 2026, DHS and USCIS made four major policy, form, address and fee updates that affect H-4 and H-4 EAD filings. Check each one before you assemble your packet so USCIS does not reject your forms at the mailroom.

First, DHS ended automatic EAD extensions for renewals. Under a DHS interim final rule effective October 30, 2025, applicants who apply to renew their EAD on or after October 30, 2025, no longer receive an automatic extension of their EAD while the renewal is pending (see our full guide to the H-4 EAD automatic extension). Prior to this rule change, category (c)(26) renewal applicants with an unexpired H-4 Form I-94 could qualify for an automatic extension of up to 540 days or until their Form I-94 expiration date, whichever was sooner.

Second, USCIS changed its mailing addresses in October 2026. On October 7, 2026, USCIS changed the direct filing locations for Form I-765, Form I-539 and Form I-129, with a 30-day grace period accepting forms sent to prior filing locations only if postmarked on or before November 9, 2026.

Third, a federal court order affects which form editions USCIS accepts. On September 14, 2026, the U.S. District Court for the District of Massachusetts issued an order in Presidents' Alliance on Higher Education and Immigration, et al., v. DHS postponing a July 17, 2026 final rule. Pursuant to that September 14, 2026 court order, USCIS continues to accept the 08/21/25 edition of Form I-765 and the 08/28/24 edition of Form I-539, and is not accepting the 09/15/26 editions of those two forms. For your spouse's Form I-129, USCIS published a new 09/09/26 edition and accepts only the 09/09/26 edition starting November 9, 2026 (accepting the 02/27/26 edition only if postmarked or submitted electronically before November 9, 2026).

Fourth, new fiscal year 2027 fees and payment rules took effect. On September 30, 2026, USCIS announced inflation-adjusted increases to certain H.R.-1 immigration-related fees for FY 2027, effective October 16, 2026, and published the 10/26/26 edition of Form G-1055, Fee Schedule, on October 28, 2026. Any benefit request postmarked on or after October 16, 2026, without the proper fee is rejected.

How to apply: standalone vs. concurrent filing with Form I-539 and Form I-129

You request an H-4 EAD by completing Form I-765, Application for Employment Authorization. In Part 2, Item Number 27, enter your eligibility category as (c)(26). In Part 2, Item Number 29, provide the 13-character receipt number of your spouse's most recent Form I-797 Notice for Form I-129, Petition for a Nonimmigrant Worker.

Do not confuse category (c)(26) with category (c)(9). If you are filing Form I-765 together with Form I-485, Application to Register Permanent Residence or Adjust Status, USCIS states you must specify your eligibility category as (c)(9), not (c)(26), and pay the Form I-485 filing fee. If you mail a Form I-765 and Form I-485 together to the category (c)(26) filing address, USCIS will reject your Form I-485 and its fees, and if you combined the fees for both forms on a single check or money order, USCIS may reject your Form I-765 as well.

Where you mail your Form I-765 depends on whether you already hold valid H-4 status or are filing to extend or change your status at the same time. When you package Form I-539 and Form I-765 together and properly file them at the same time and in the same location as your H-1B spouse's Form I-129, USCIS adjudicates your dependent applications right after reviewing your spouse's Form I-129. However, USCIS will not make a decision on your Form I-765 until after it has adjudicated your underlying Form I-539, your spouse's Form I-129, or both.

Documents required for an H-4 EAD application

USCIS requires legible photocopies of your supporting documents unless it specifically asks for an original. Do not mail original documents unless requested, because USCIS notes it may destroy unrequested originals after receiving them. If any document contains a foreign language, you must include a full English translation with a signed translator certification stating that the translation is complete and accurate and that the translator is competent to translate from the foreign language into English, along with their printed name, signature date and contact information.

According to the Form I-765 Instructions, assemble your packet in this exact order: first your filing fee payment, second your properly signed Form I-765 (all pages, with the 08/21/25 edition date visible at the bottom), and third your supporting documents:

  • Proof of your H-4 status: A copy of your current Form I-797 approval notice for Form I-539, or a copy of your Form I-94 (Arrival/Departure Record, available at cbp.gov/i94) showing your admission as an H-4 nonimmigrant or your most recent approved extension of stay.
  • Government-issued photo ID: A copy of your last EAD (front and back, if any). If you have never held an EAD, submit a copy of the biometric page of your passport, a birth certificate with photo ID, a visa issued by a foreign consulate, or a national identity document with a photo.
  • Proof of relationship to the H-1B principal: A copy of your marriage certificate. If you have used other names (such as a maiden name), include evidence of those names, and if applicable, divorce or death certificates showing the termination of any prior marriages.
  • Two identical 2x2-inch color passport photos: Taken recently against a white to off-white background, printed on thin paper with a glossy finish, unmounted and unretouched. Head height must measure 1 to 1 3/8 inches and eye height must measure between 1 1/8 to 1 3/8 inches from the bottom of the photo. Lightly print your name and A-Number (if any) on the back of each photo with a pencil or felt pen. Submitting mounted or digitally retouched photos will delay processing and may prompt USCIS to require an in-person appearance at an Application Support Center (ASC).
  • Proof of basis for eligibility under Pathway 1 (Approved I-140): A copy of the Form I-797 approval notice for the Form I-140 filed for your H-1B spouse.
  • Proof of basis for eligibility under Pathway 2 (AC21 106(a) and (b)): Copies of your H-1B spouse's passports, prior Forms I-94, and current and prior Forms I-797 for Form I-129, plus either (a) a Department of Labor (DOL) website printout or correspondence showing your spouse's PERM was filed at least 365 days before the AC21 admission period began (and a copy of the Form I-797 receipt notice for Form I-140 showing it was filed within 180 days of DOL certification, if certified), or (b) a copy of the Form I-797 receipt notice showing your spouse's Form I-140 was filed at least 365 days before the AC21 admission period began.
  • Secondary evidence (if primary evidence of your spouse's eligibility is unavailable): You may ask USCIS to consider secondary evidence, such as the receipt number of your spouse's most current Form I-129 extension of stay request or the receipt number of the approved Form I-140 petition.

Biometrics, fees and payment rules for H-4 and H-4 EAD filers

Beginning October 1, 2023, USCIS exempted the $85 biometric services fee for all Form I-539 applicants, including those applying for H-4 status. If you mistakenly submit the $85 biometric services fee and combine that payment with a paper-based Form I-539 filing fee, USCIS considers it an incorrect filing and will reject your Form I-539. If you submit the $85 fee as a separate payment, USCIS returns the biometric fee and accepts the Form I-539. If you authorize a credit card payment combining both, USCIS accepts the application and charges only the application fee.

While routine appointments are gone for most filers, USCIS retains the general authority under 8 CFR 103.2(b)(9) to require biometrics (fingerprints, photograph and digital signature) from any applicant to verify identity, run FBI background checks or produce an EAD card. If USCIS schedules an ASC appointment (Form I-797C) and you need to reschedule, you must make the request through your USCIS online account at least 12 hours before your scheduled appointment time and establish good cause.

When paying your filing fees by mail, Form G-1055 (edition 10/26/26) states you can pay by credit, debit or prepaid card using Form G-1450, or directly from a US bank account using Form G-1650 (Authorization for ACH Transactions). If you qualify for an exemption from electronic payment, you must include a completed and signed Form G-1651 (Exemption for Paper Fee Payment) with your paper fee payment.

Processing time, card delivery and tracking your case

To receive an email or text notification when a USCIS lockbox accepts your forms, clip Form G-1145, E-Notification of Application/Petition Acceptance, to the first page of your application package. Once USCIS receives your application, it sends a Form I-797C, Notice of Action, containing your unique 13-character receipt number (three letters such as EAC, WAC, LIN, SRC, NBC, MSC or IOE followed by 10 numbers). You can enter this number (omitting dashes, but keeping asterisks if printed on your notice) on the USCIS Case Status Online tool to see the last action taken on your case.

If you filed Form I-765 together with Form I-539, USCIS does not adjudicate Form I-765 until after it approves the Form I-539. Similarly, if your spouse loses H-1B status or enters the H-1B 60-day grace period, your derivative status and EAD timeline are tied to the underlying status rules.

After USCIS approves your Form I-765, your EAD card should be produced within 2 weeks and mailed via U.S. Postal Service (USPS) Priority Mail. You can find your USPS tracking number in Case Status Online, and USCIS asks applicants to allow 30 days from approval before submitting a non-delivery inquiry through e-Request. If you move while your case is pending, you must notify USCIS of your new address within 10 days of moving.

EAD validity, the 180-day renewal window and worked timeline example

According to Volume 10, Part B, Chapter 2 of the USCIS Policy Manual, USCIS generally grants an H-4 dependent spouse EAD with a validity period that aligns with your Form I-94 expiration date, not to exceed 3 years (by contrast, E and L dependent spouse EADs are capped at 2 years, and E and L spouses are employment authorized incident to status). You cannot file for a renewal EAD (checking Item Number 1.c. in Part 1 of Form I-765) more than 180 days before your current EAD expires. USCIS generally does not backdate or postdate a renewal EAD to the end of your current card's validity period, and advises filing at least 90 days before expiration.

Worked example of the 2026 renewal timeline: Suppose your current H-4 Form I-94 and category (c)(26) EAD both expire on December 31, 2026, and your spouse's employer is extending their H-1B status.

  • 180 days before expiration (July 4, 2026): Your earliest possible date to file a Form I-765 renewal under the 180-day rule, and the window to bundle Form I-129, Form I-539 and Form I-765 together at the Form I-129 service center.
  • 90 days before expiration (October 2, 2026): The latest recommended filing benchmark on the USCIS Form I-765 page.
  • 45 days before expiration (November 16, 2026): The date by which USCIS suggests filing Form I-539 before your authorized stay expires.
  • Expiration date (December 31, 2026): Because your renewal was filed on or after October 30, 2025, there is no automatic EAD extension. If your new EAD card has not been approved and received by December 31, 2026, you must stop working after that date until the new Form I-766 card arrives.

What if you filed your renewal before October 30, 2025, or get a card with an error?

If you timely filed a Form I-765 renewal before the October 30, 2025 DHS interim final rule took effect, the earlier automatic extension rules still govern that filing. Under the temporary final rules covering filings from May 4, 2022 through September 2025 (and the Policy Manual baseline rule), a pending category (c)(26) renewal qualified for an automatic extension of up to 540 days (or up to 180 days under the baseline Policy Manual rule) or until the Form I-94 expiration date, whichever came earlier, only if you held an unexpired H-4 Form I-94. To prove an eligible pre-October 30, 2025 automatic extension for Form I-9 verification, an employee presents three documents together: the facially expired EAD showing Category C26, the Form I-797C receipt notice showing a timely renewal filing in category (c)(26), and an unexpired Form I-94 reflecting H-4 status.

If your new EAD arrives with incorrect information not due to a USCIS error, you must file a new Form I-765 (selecting box 1.b.), pay the filing fee, include required documents, and return the card containing the error. If the error is due to a USCIS error, you do not need to submit a new Form I-765 or pay a filing fee: submit a service request online selecting "EAD Replacement due to USCIS Error" (for a clear typographical error) or mail a letter explaining the error with supporting evidence, and return the original card via USPS (UPS, FedEx and DHL cannot deliver to this address) to USCIS Lee's Summit Production Facility, Attn: I-765 Replacement Cards, 7 Product Way, Lee's Summit, MO 64002. USCIS takes approximately 30 days from receiving the card to process the correction.

Frequently asked questions

Who is eligible to apply for an H-4 EAD?

You are eligible if you are the H-4 dependent spouse of an H-1B nonimmigrant and your H-1B spouse is either the principal beneficiary of an approved Form I-140, or has been granted H-1B status beyond the 6-year limit under sections 106(a) and (b) of AC21. H-4 dependent children are not eligible.

Did the automatic extension for H-4 EAD renewals end?

Yes. Under a DHS interim final rule effective October 30, 2025, applicants who apply to renew their EAD on or after October 30, 2025, no longer receive an automatic extension of their EAD while the renewal is pending (see our full guide to the H-4 EAD automatic extension).

Can I file Form I-765 for an H-4 EAD at the same time as Form I-539?

Yes. You can file Form I-765 concurrently with Form I-539, or package both Form I-539 and Form I-765 together with your spouse's Form I-129 at the same time and filing location. However, USCIS will not decide your Form I-765 until after it has adjudicated your Form I-539 (and your spouse's Form I-129, if filed together).

What eligibility category code do I put on Form I-765 for an H-4 EAD?

Enter (c)(26) in Part 2, Item Number 27 of Form I-765, and enter your H-1B spouse's most recent Form I-797 receipt number for Form I-129 in Part 2, Item Number 29. If you are filing Form I-765 concurrently with Form I-485, you must enter category (c)(9) instead of (c)(26).

Do I have to pay a biometrics fee when filing Form I-539 with my H-4 EAD?

No. Beginning October 1, 2023, USCIS exempted the $85 biometric services fee for all Form I-539 applicants, and combining a mistaken $85 fee with a paper Form I-539 filing fee will cause USCIS to reject your Form I-539. Most applicants are not scheduled for a biometrics appointment unless USCIS determines one is needed.

How early can I file for an H-4 EAD renewal, and how long is the card valid?

You can file a renewal Form I-765 up to 180 days before your current EAD expires, and USCIS recommends filing at least 90 days before expiration. An approved H-4 EAD is valid through the expiration date on your most recent H-4 Form I-94, up to a maximum of 3 years.
