F-1 to H-1B: cap-gap extension, change of status, and travel rules

When your employer files a timely cap-subject H-1B petition requesting a change of status while you are in valid F-1 status, the automatic cap-gap extension bridges the gap until your H-1B begins. Under a DHS final rule effective January 17, 2025, this extension keeps your F-1 status and active OPT or STEM OPT work authorization valid until April 1 of the fiscal year for which H-1B status is requested, or until your approved H-1B start date, whichever comes first.

If you travel outside the United States while your change of status request is still pending, USCIS considers the change of status abandoned and you will need an H-1B visa stamp abroad before returning in H-1B status.

How does the F-1 to H-1B cap-gap extension work after the 2025 rule?

Many F-1 students finish their academic program or post-completion Optional Practical Training (OPT) in the spring or summer, while a new cap-subject H-1B petition cannot take effect until October 1 at the earliest. That gap exists because federal rules bar employers from filing a cap-subject Form I-129 more than 6 months before the date of actual need, making April 1 the earliest filing date for an October 1 fiscal year start.

To keep qualifying students from losing status or having to stop working while they wait, Department of Homeland Security (DHS) regulations provide an automatic cap-gap extension. Under the final H-1B rule that took effect on January 17, 2025 (applying starting with the FY 2026 registration period), DHS extended the cap-gap end date from October 1 to April 1 of the relevant fiscal year. Your cap-gap period starts when your F-1 status and employment authorization expire and runs until April 1 of the fiscal year for which H-1B status is requested or until the validity start date of your approved petition, whichever is earlier.

Lottery selection by itself does not grant a cap-gap extension. Your employer must file the Form I-129 petition with U.S. Citizenship and Immigration Services (USCIS) based on a valid, selected H-1B registration while your authorized F-1 duration of status (D/S) is still in effect. The petition must request a change of status with a start date between October 1 of the current year and April 1 of the following year. Petitions requesting consular processing and petitions filed by cap-exempt employers (institutions of higher education, affiliated nonprofit entities, nonprofit research organizations, and government research organizations) do not qualify for cap-gap.

What the automatic cap-gap extension covers based on when Form I-129 is filed

Your status when the H-1B petition is filedDoes F-1 status extend?Does work authorization extend? When the extension ends
Active post-completion OPT or 24-month STEM OPT (EAD not yet expired)Yes, automatically (including F-2 dependents)Yes, until April 1 of the fiscal year or the approved H-1B start date, whichever is earlierApril 1 of the fiscal year, the approved H-1B start date, or immediately upon rejection, denial, revocation, or withdrawal

What does the timeline from March lottery to H-1B start date look like?

Congress limits new cap-subject H-1B visas to 65,000 under the regular cap each fiscal year (with up to 6,800 set aside for H-1B1 Chile and Singapore trade visas), plus an additional 20,000 under the U.S. advanced degree exemption for beneficiaries with a master's or higher degree from an accredited U.S. institution of higher education. If you are selected under the master's cap based on a degree you are finishing, you must earn that degree before the employer files Form I-129, or USCIS will deny or reject the petition.

Before filing Form I-129, your employer submits an electronic registration during the March window (at least 14 calendar days, such as March 4 at noon Eastern to March 19 at 5:00 p.m. Eastern for FY 2027) and pays the non-refundable $215 registration fee per beneficiary. Starting in FY 2027, when random selection is needed, USCIS uses a beneficiary-centric weighted selection process based on the Occupational Employment and Wage Statistics (OEWS) wage level that the proffered salary equals or exceeds: Wage Level IV registrations enter the selection pool 4 times, Level III 3 times, Level II 2 times, and Level I 1 time. Each person counts as one unique beneficiary regardless of how many employers register them.

By our calculation from USCIS historical registration data, total eligible registrations fell 26.9% from 470,342 in FY 2025 to 343,981 in FY 2026 after USCIS introduced beneficiary-centric selection, and USCIS selected 120,141 registrations in FY 2026 (about 34.9% of eligible registrations). Once selected by March 31, your employer gets a 90-day filing window beginning April 1 to obtain a certified Labor Condition Application (LCA, Form ETA-9035) from the Department of Labor and submit the Form I-129 package to USCIS.

Worked example of the filing deadline trap (invented dates by our team to illustrate USCIS rules): Suppose your post-completion OPT EAD expires on May 15, and your 60-day grace period ends on July 14. Your employer's registration is selected on March 31, giving a 90-day window (April 1 to June 30) to file Form I-129. If your employer files Form I-129 on May 10 (before your EAD expires), both your F-1 status and your work authorization continue through April 1 of the next year or until your H-1B start date. If your employer waits until June 1 to file (inside the 90-day window, but during your 60-day grace period), you must stop working on May 15. The June 1 filing extends your lawful F-1 stay, but you cannot work again until your H-1B change of status takes effect.

Change of status vs. consular processing: how do you choose?

When your employer prepares Form I-129, they must select either a change of status inside the United States or consular notification abroad. For F-1 students on OPT, that single checkbox determines whether you get cap-gap protection and whether you must leave the country to activate your H-1B.

You may also have heard rumors about a $100,000 H-1B fee. On September 19, 2025, a Presidential Proclamation required an additional $100,000 payment for certain H-1B petitions filed on or after September 21, 2025, when the beneficiary was outside the U.S., requested consular notification, or abandoned or was denied a change of status. First, USCIS states that the Proclamation never applied to a petition requesting a change of status for someone inside the U.S. where the change of status is granted, nor does it apply if that worker later travels abroad to get an H-1B visa stamp based on the approved petition. Second, on June 8, 2026, the U.S. District Court for the District of Massachusetts vacated the agency guidance implementing the $100,000 payment. The First Circuit denied the government's stay motion on July 24, 2026, so USCIS is complying with the court order and not collecting the payment while the case proceeds.

Change of Status vs. Consular Processing for F-1 Students

International travel while Form I-129 is pendingAbandons the change of status request and terminates cap-gap re-entry eligibilityAllowed (if you otherwise maintain valid F-1 travel documents and OPT rules), because no change of status request is pending
When you need an H-1B visa stampNot needed to start H-1B work in the U.S. It is needed only the next time you travel internationally after H-1B takes effectRequired before you can enter the U.S. in H-1B status and start H-1B employment

Can you travel outside the US during cap-gap or while H-1B is pending?

Your travel rights depend on whether your H-1B change of status petition is still pending or already approved, and whether your H-1B start date has arrived.

If you travel while your H-1B change of status is pending: Leaving the United States while your Form I-129 change of status request is pending automatically abandons the change of status portion of the petition. Your F-1 cap-gap extension ends, and you cannot re-enter in F-1 status under cap-gap provisions. If USCIS approves the underlying H-1B petition, it issues it as a consular notification, meaning you must apply for an H-1B visa stamp at a U.S. embassy or consulate abroad and seek admission from U.S. Customs and Border Protection (CBP) to obtain H-1B status.

If you travel during cap-gap after your H-1B change of status is approved: Study in the States and USCIS allow you to travel abroad during cap-gap and seek readmission in F-1 status only if you meet every one of these requirements:

  • USCIS has already approved both your H-1B petition and your request for change of status.
  • You seek readmission to the United States before your H-1B employment start date takes effect (normally before October 1).
  • You are otherwise admissible and carry a valid passport, a valid F-1 visa stamp, and a valid Form I-20 signed for travel by your DSO showing the cap-gap extension.
  • You do not need an unexpired EAD card at the port of entry during cap-gap, because USCIS does not renew EAD cards for the cap-gap period.
  • A CBP officer at the port of entry always makes the final decision on whether to admit you.

How does H-1B visa stamping work after a change of status?

An approved Form I-129 petition (Form I-797 Notice of Action) changes your status inside the United States, but USCIS form instructions state directly that evidence of a petition approval is not a visa. Your F-1 visa stamp cannot be used to re-enter the United States once your status has changed to H-1B.

The first time you travel outside the United States on or after your H-1B effective date, you must book a visa appointment at a U.S. embassy or consulate abroad (unless you are visa-exempt) to get an H-1B visa stamp in your passport before flying back, and present your passport, H-1B visa, and Form I-797 to CBP. [PRACTICE_BOX]

  • What is your job title, what are your daily duties, and how does your degree relate to this role? (Checks specialty occupation criteria and degree match on Form I-129. Have your diploma, transcripts, and employer support letter ready.)
  • What is your salary and where is your physical worksite? (Checks that your pay and location match the certified LCA. Carry a copy of your Form I-129, certified LCA, and recent pay stubs.)
  • Did you work between the expiration of your OPT EAD and your H-1B start date? (Checks that gap work was covered by a valid cap-gap or STEM OPT extension. Bring all prior Forms I-20 including your cap-gap I-20 and EAD cards.)
  • How many days were you unemployed while on OPT or STEM OPT? (Checks that you stayed within the 90-day OPT or 150-day cumulative STEM OPT unemployment limit. Bring OPT offer letters, pay stubs, and SEVP Portal employment history.)

How do you get a cap-gap I-20, update Form I-9, and request a SEVIS data fix?

Because the cap-gap extension is automatic, you do not file an application or receive a new EAD card. An updated Form I-20 from your Designated School (DSO) is your proof of continuing status, while your employer uses a specific document combination for Form I-9.

Step-by-step checklist for your DSO and HR team (compiled by our team from USCIS M-274 and SEVIS Help Hub guidance):

  • 1. Confirm timely filing before your EAD expires: If your EAD expires before your Form I-797C receipt arrives, give your DSO a copy of the filed H-1B petition (showing a change of status request) and the FedEx, UPS, or USPS Express/certified mail receipt. You can continue working while the Form I-20 update is processed.
  • 2. Send the Form I-797C receipt notice to your DSO: Once your employer gets Form I-797C with a valid receipt number, send a copy to your DSO to get an updated Form I-20 showing OPT extended until April 1 of the fiscal year.
  • 3. Check SEVIS or request a data fix after 2 weeks: The USCIS CLAIMS interface usually updates SEVIS automatically to show a cap-gap indicator and print a comment on Page 2 of Form I-20. If it does not, your DSO should wait two weeks after USCIS confirms timely receipt, then contact the SEVP Response Center (sevp@ice.dhs.gov or 1-800-892-4829) with a copy of the Form I-797 receipt notice for a data fix.
  • 4. Complete or update Form I-9: Under the USCIS Handbook for Employers (M-274, Section 7.4.2), your expired OPT EAD combined with your employer's Form I-797C receipt notice counts as an unexpired List A document. A new hire selects 'An alien authorized to work until' and enters 'March 31' of the fiscal year in Section 1, while the employer enters 'EAD', the Form I-797C receipt number, 'March 31' of the fiscal year, and 'CAP-GAP' in Section 2. For an existing employee, the employer enters 'CAP-GAP 03/31/yyyy' in Section 2 Additional Information.
  • 5. Reverify on Form I-9 Supplement B: Your employer must reverify your employment authorization on Supplement B on or before March 31 of the relevant year using the new Form I-94 attached to your Form I-797 approval notice.

What happens if your H-1B is denied, withdrawn, or you are laid off before it starts?

During cap-gap, all F-1 OPT rules still apply. Unemployment days during cap-gap count toward the 90-day maximum for initial post-completion OPT or the 150-day cumulative maximum for a 24-month STEM OPT extension, and you must report address or employment changes to your DSO within 10 days (plus 6-month validation reports and Form I-983 evaluations on STEM OPT).

Concurrent STEM OPT filing: USCIS allows students on a cap-gap extension of post-completion OPT to apply for a 24-month STEM OPT extension while cap-gap is active. However, you cannot apply for STEM OPT once cap-gap terminates (due to H-1B rejection, denial, revocation, or withdrawal) and you enter the 60-day grace period.

If your H-1B petition is denied, rejected, revoked, or withdrawn: Your cap-gap extension terminates immediately. If your OPT EAD has expired (without a pending or approved STEM OPT extension), you must stop working immediately. You receive the standard 60-day grace period from the notification date (or your original program/OPT end date, whichever is later) to depart, transfer, or change status, unless the change of status was denied or revoked for a status violation, fraud, or misrepresentation, in which case you must leave immediately.

If you are laid off before your H-1B start date: If your H-1B change of status is approved but your employer terminates your job before the H-1B effective date, you can retrieve unused OPT and stay in F-1 status if you have an unexpired post-completion OPT EAD. Make sure USCIS receives a withdrawal request from the employer before the H-1B effective date, then give your DSO the USCIS withdrawal acknowledgment (revocation notice) to request a SEVIS data fix. If the employer withdrew the petition before the effective date, your OPT EAD is unexpired, and you have appropriate OPT employment, you may keep working while the data fix is pending. If withdrawn on or after the H-1B effective date, your status changes to H-1B and you must stop working, file Form I-539 to change back to F-1, and wait for approval before resuming OPT.

Frequently asked questions

How long does the F-1 cap-gap extension last under the 2025 H-1B rule?

Under the DHS final rule effective January 17, 2025, the cap-gap period starts when your F-1 status and OPT employment authorization expire and lasts until April 1 of the fiscal year for which H-1B status is requested or until the validity start date of your approved H-1B petition, whichever is earlier.

Can I work during cap-gap if my H-1B was filed during my 60-day grace period?

No. Because your employment authorization had already ended when you entered the 60-day grace period, filing an H-1B change of status petition during the grace period extends only your lawful F-1 stay in the United States, not your permission to work.

What happens if I travel outside the US while my H-1B change of status is pending?

USCIS will consider your change of status request abandoned and you will lose your ability to re-enter in F-1 status under cap-gap provisions. Once the H-1B petition is approved, it will be treated as a consular notification, meaning you must apply for an H-1B visa stamp at a U.S. embassy or consulate abroad before returning.

Can I travel internationally during cap-gap after my H-1B change of status is approved?

Yes, provided USCIS has already approved both your H-1B petition and change of status request, you seek readmission before your H-1B employment start date (normally October 1), and you carry a valid passport, a valid F-1 visa stamp, and a valid Form I-20 signed by your DSO.

What documents do I show my employer for Form I-9 during cap-gap?

USCIS does not issue a new EAD card for cap-gap. According to the USCIS M-274 Handbook for Employers, your expired OPT EAD card combined with your employer's Form I-797C receipt notice serves as an acceptable List A document through March 31 of the fiscal year.

Can I apply for a 24-month STEM OPT extension while I am on a cap-gap extension?

Yes, USCIS allows eligible students to apply for a 24-month STEM OPT extension while their cap-gap extension is active. However, you cannot apply for STEM OPT if your H-1B petition is denied, rejected, revoked, or withdrawn after your EAD expires and your cap-gap period has terminated.
